novelia Terms of Service
Terms of Service for the AI story generation service "novelia" operated by Novelia.

1. Acceptance of Terms
By accessing or using novelia ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and Novelia ("we," "us," or "our").
2. Eligibility
- You must be at least 13 years old to use the Service. The Service is not directed to children under 13 (COPPA compliance).
- Users under 18 require parental or guardian consent.
- By using the Service, you represent that you meet these requirements.
3. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
- Notify us immediately at support@novelia.site of any unauthorized use of your account.
4. Points & Subscriptions
- Points are purchased in Japanese yen and are usable only within the Service.
- Points expire 180 days from grant date. Expired points are forfeited.
- Points cannot be rolled over, exchanged for cash, or transferred to another user.
- Subscriptions auto-renew monthly or annually until cancelled.
5. Refund Policy
Refunds are available only in the following cases: (a) system failure resulting in points not being credited; (b) duplicate charges; (c) fraudulent transactions; (d) as required by applicable law.
No refunds will be issued for change of mind or points already used. To request a refund, email support@novelia.site with your transaction ID.
6. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Generate content that is sexually explicit involving minors
- Generate content that promotes violence, hatred, or discrimination
- Infringe any intellectual property rights of third parties
- Harass, defame, or threaten other users
- Attempt unauthorized access to the Service or other users' accounts
- Distribute spam, phishing content, or malware
- Reverse-engineer, decompile, or disassemble the Service
- Use the Service for any commercial purpose without our prior written consent
7. Intellectual Property
- Your content: You retain ownership of stories and other content you generate using the Service ("User Content").
- License to us: By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your User Content solely for (i) operating and improving the Service, and (ii) promotional purposes (with attribution).
- Our intellectual property: The Service's software, design, trademarks, and brand elements are owned by or licensed to us. You may not use them without our prior written consent.
8. DMCA / Copyright Takedown
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a DMCA takedown notice to:
Your notice must include: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; (6) your physical or electronic signature.
9. Disclaimer of Warranties & AI-Generated Content
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.
We accept no responsibility whatsoever for any AI-generated content, including but not limited to: story narratives, plot direction, themes, character portrayals, dialogue, and generated images — in terms of quality, accuracy, appropriateness, or ethical suitability.
- AI is a probabilistic language model; results may not fully match your expectations. This is an inherent characteristic of the technology, not a service defect.
- Dissatisfaction with AI-generated content — including story quality, narrative direction, character behavior, or image output — does not constitute grounds for a refund under any circumstances.
- The same prompt may produce different outputs each time.
- We bear no responsibility for the specific expressions, themes, or imagery contained in AI-generated text or images.
- If you are unsatisfied with an episode, you may use Episode Regeneration (900pt) or Episode Plan Editing (500pt) to improve results.
- Providing detailed descriptions in the "Custom Settings" field significantly improves output quality.
10. Fiction Disclaimer
All stories, characters, settings, and images generated through the Service are entirely fictional.
- All characters, organizations, locations, and entities depicted in generated content are fictitious. Any resemblance to actual persons, living or dead, or actual organizations, entities, or events is purely coincidental.
- The events, situations, ideologies, and beliefs depicted in stories do not reflect the views or positions of Novelia.
- AI-generated content may coincidentally resemble real individuals, events, or places. This is unintentional, and we accept no liability for any such resemblance.
- Using generated content to defame, harass, or damage the reputation of real individuals or organizations is strictly prohibited.
11. User Content Responsibility
You are solely responsible for all content you generate, publish, or share through the Service.
- If your content infringes any third-party rights (including copyright, portrait rights, privacy, or reputation), you bear full responsibility. We accept no liability for user-generated content.
- We are not responsible for inappropriate content resulting from your prompts, settings, or instructions.
- We reserve the right to remove content that violates these Terms or applicable laws without prior notice.
- If any third-party claim or legal action arises from your content, you agree to indemnify and hold us harmless from all costs, damages, and liabilities.
12. Service Availability
We do not guarantee uninterrupted availability of the Service. The Service may be temporarily suspended due to:
- System maintenance, updates, or inspections
- Force majeure events (natural disasters, power outages, network failures)
- Third-party service disruptions (AI APIs, cloud infrastructure)
- Other circumstances we deem necessary
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
14. Dispute Resolution & Arbitration (US Users)
If you are a resident of the United States, the following arbitration clause applies:
- Any dispute arising from these Terms will be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court.
- Class action waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.
- Opt-out: You may opt out of arbitration by emailing support@novelia.site within 30 days of first using the Service. Include your name, email, and "Arbitration Opt-Out" in the subject line.
15. Governing Law
These Terms are governed by the laws of Japan. For users outside Japan, nothing in these Terms limits your rights under the mandatory laws of your country of residence. For EU/EEA users, consumer protection laws in your country may provide additional rights not limited by these Terms.
16. Service Changes & Termination
- We may modify or discontinue the Service with reasonable notice.
- We may suspend or terminate your account for violation of these Terms.
- Upon Service termination, we will provide reasonable accommodation for unused point balances.
17. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via in-Service notice or email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance.
