Terms of Service for the AI story generation service "novelia" operated by Novelia.

1. Acceptance of Terms
By accessing or using novelia ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and Novelia ("we," "us," or "our").
2. Definitions
- "Service": The AI story generation platform "novelia" operated by Novelia
- "User": An individual or entity registered with the Service
- "Content": Text, images, audio, and other materials generated or posted through the Service
- "Points": Virtual currency usable within the Service
- "Derivative Work": Content created using characters, settings, or worlds from existing novels, manga, anime, games, etc.
3. Operator Information
4. Eligibility
- You must be at least 13 years old to use the Service. The Service is not directed to children under 13 (COPPA compliance).
- Users aged 13–17 require parental or guardian consent. We may verify such consent.
- If you have been previously suspended from the Service, you may not re-register without our explicit approval.
- Users in U.S.-sanctioned countries/regions or persons listed on prohibited-party lists may not use the Service.
5. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- One account per user, in principle. Multiple accounts require our prior consent.
- You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately at support@novelia.site of any unauthorized use.
- Impersonation is grounds for immediate termination without notice.
6. Account Suspension, Deletion & Closure
- You may close your account at any time via settings or by emailing support@novelia.site.
- Upon closure, your published Content will be deleted or anonymized at your choice. Unused Points are forfeited; no refund is provided.
- Personal data is deleted within a reasonable period (max 90 days) after closure, except where retention is legally required. See our Privacy Policy for details.
- We may suspend or terminate your account without prior notice if you:
- Violate the Prohibited Conduct provisions (Section 11)
- Are inactive for more than 12 months
- Have payment disputes or fraudulent transactions
- Cause harm or threaten harm to us, other users, or third parties
- Are affiliated with anti-social forces or repeatedly violate the Terms
- Suspended users may appeal to support@novelia.site, and we will respond within a reasonable period.
7. Points & Subscriptions
- Points are purchased in the currency corresponding to your region (Japanese yen or US dollars) and usable only within the Service.
- Points expire 180 days from grant date. Expired points are forfeited.
- Points cannot be rolled over, exchanged for cash, or transferred to another user.
- Subscriptions auto-renew monthly or annually until cancelled. Cancellation takes effect at the end of the current billing cycle.
- Payments are processed by Stripe and other payment processors. We do not store your payment card information.
- Applicable taxes (VAT, sales tax, consumption tax) are included or added per your region.
7-2. Free Bonus Points & Daily Login Bonus
We may, at our sole discretion, grant complimentary points such as signup bonuses, daily login bonuses, and campaign bonuses. The following terms apply:
- Signup bonus: 5,000pt awarded upon account creation, once per user.
- Daily login bonus: 10pt awarded when a verified account (email-verified, Google-authenticated, or LINE-authenticated) accesses the Service for the first time within a JST 24-hour period. Streak bonuses are awarded as follows:
- 3-day streak (first time only): +100pt onboarding bonus
- 7-day streak milestones (7, 14, 21, ...): +50pt
- 30-day streak milestones (30, 60, 90, ...): +500pt
Streaks are counted based on JST midnight. Missing a day resets the streak counter. - Eligibility: Only verified accounts (email-verified or OAuth via Google / LINE) that are not deactivated, banned, or deleted are eligible.
- Nature of free points: Bonus points can be used identically to purchased points within the Service but are never refundable, transferable, or convertible to cash.
- Anti-abuse: Acquiring bonus points through multi-account farming, automated tools (bots), impersonation, or other fraudulent means is strictly prohibited. We reserve the right to take any of the following actions, without prior notice, upon discovering such conduct:
- Forfeit fraudulently acquired points
- Suspend or permanently terminate the offending account
- Revoke bonus eligibility across all related accounts
- Pursue damages where applicable
- Right to modify: We reserve the right to modify the bonus amount, streak thresholds, and eligibility criteria, or to discontinue the program entirely, with or without notice. We are not liable for any disadvantage resulting from such changes.
8. Refund Policy
Refunds are available only in the following cases: (a) system failure resulting in points not being credited; (b) duplicate charges due to our fault; (c) unauthorized transactions; (d) where required by applicable law (consumer protection, e-commerce regulations).
No refunds for change of mind, used points, or dissatisfaction with AI-generated content. To request a refund, email support@novelia.site with your transaction ID.
9. Minors' Right to Rescind (Japanese Users)
Under Article 5 of the Japanese Civil Code, purchases made by minors (under 18) without legal guardian consent may be rescinded. Minors or their guardians may request rescission by emailing support@novelia.site with appropriate documentation. Rescission may not be available if the minor misrepresented their age (Civil Code Art. 21).
10. Specified Commercial Transactions Act Disclosure (Japan)
Detailed transaction terms, business operator information, payment methods, delivery timing, and cancellation conditions are provided in our Specified Commercial Transactions Act Disclosure. In case of conflict between these Terms and the Disclosure, the latter prevails for matters of consumer protection.
11. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Harass, defame, threaten, or stalk other users or third parties
- Infringe any intellectual property, portrait, privacy, reputation, or other rights of third parties
- Generate, post, or publish content that promotes obscenity, discrimination, violence, or terrorism
- Generate, post, or publish adult content (stories, images, audio, or other materials containing sexually explicit descriptions). We reserve the right to delete such content and associated accounts without prior notice. No point refunds for deletions under this clause.
- Generate content that is sexually explicit involving minors (CSAM is strictly prohibited under all jurisdictions)
- Disrupt the operation of the Service (excessive load, server attacks, vulnerability scanning)
- Attempt unauthorized access to the Service or other users' accounts
- Distribute spam, phishing content, or malware
- Use the Service for any commercial purpose without our prior written consent
- Reverse-engineer, decompile, or disassemble the Service or extract its source code
- Engage with anti-social forces (organized crime, gangs, etc.)
- Use the Service for money laundering, drug trafficking, weapons trade, or other illegal activities
12. Content Moderation
- We employ AI-based automated detection and user reporting to moderate Content on the Service.
- When violations are detected, we may make Content private, delete it, and suspend the responsible accounts without prior notice.
- If your Content is removed in error, you may appeal to support@novelia.site. We will respond within a reasonable period.
- We do not pre-screen Content; users are responsible for what they post.
13. DMCA / Copyright Takedown
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a DMCA takedown notice to:
Your notice must include:
- Identification of the copyrighted work or right you claim is infringed
- Identification of the allegedly infringing material (URL, story ID, etc.)
- Your contact information (name, email, phone, address)
- A statement that you are the rightsholder or authorized agent
- A statement of accuracy under penalty of perjury
- Your physical or electronic signature
We respond within a reasonable period (typically 7 business days). The Content's author will be given the opportunity to file a counter-notice.
14. Derivative Works Policy
- The Service permits creation of derivative works based on existing novels, manga, anime, games, etc., subject to (a) not infringing the original creator's rights, and (b) following the original creator's/publisher's guidelines.
- Upon receipt of a takedown request from an original creator or rightsholder, we will promptly remove or hide the affected work (see Section 13).
- Commercial use (sales, print distribution, etc.) requires the original creator's permission. Sharing within the Service for viewing purposes only is permitted.
- Excessive deviation from the original (e.g., defaming actual rightsholders) is prohibited.
- For any third-party claims regarding derivative works, you bear sole responsibility; we accept no liability.
15. Intellectual Property
- Your content: You retain ownership of stories and other content you generate using the Service ("User Content").
- License to us: By using the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, and display your User Content solely for (i) operating and improving the Service, and (ii) promotional purposes.
- SNS Promotion: Published works (titles, synopses, illustrations) may be used for advertising and promotion on our social media (X/Twitter, etc.). Crediting is at our discretion.
- Our intellectual property: The Service's software, design, logos, trademarks, brand elements, and database structure are owned by us or our licensors. You may not use them without our prior written consent.
- AI models, prompts, style LoRAs, and similar elements provided through the Service remain the intellectual property of their respective owners.
16. AI Training Data Policy
- We do not, by default, use your prompts, settings, or generated Content to train our AI models.
- We may aggregate anonymized statistics for service improvement.
- Third-party AI providers (Claude, GPT, ElevenLabs, etc.) handle data per their own policies. Please review each provider's privacy policy.
- To opt out of training-related uses, see Section 6 of our Privacy Policy.
17. Disclaimer of Warranties & AI-Generated Content
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.
We accept no responsibility whatsoever for any AI-generated content (story narratives, plot direction, themes, character portrayals, dialogue, generated images, audio) — in terms of quality, accuracy, appropriateness, or ethical suitability.
- AI is a probabilistic language model; results may not match your expectations. This is an inherent characteristic of the technology, not a service defect.
- Dissatisfaction with AI-generated content is not grounds for a refund.
- The same prompt may produce different outputs each time.
- If unsatisfied, you may use Episode Regeneration, Episode Plan Editing, Character Image Regeneration, etc.
18. Fiction Disclaimer
All stories, characters, settings, images, and audio generated through the Service are entirely fictional.
- All characters, organizations, locations, and entities are fictitious. Any resemblance to actual persons, organizations, or events is purely coincidental.
- The events, situations, ideologies, and beliefs depicted do not reflect our views.
- AI-generated content may coincidentally resemble real individuals or events. We accept no liability for such resemblance.
- Using generated content to defame, harass, or damage the reputation of real individuals or organizations is strictly prohibited.
19. User Content Responsibility
You are solely responsible for all content you generate, publish, or share through the Service.
- If your content infringes third-party rights (copyright, portrait, privacy, reputation, etc.), you bear full responsibility.
- We are not responsible for inappropriate content resulting from your prompts, settings, or instructions.
- We reserve the right to remove violating content without prior notice.
20. API, Scraping & Bot Restrictions
- Without our prior written consent, you may not perform automated mass access (scraping, crawling, bots) against the Service.
- Obtaining, copying, or republishing Service data through means other than our official API is prohibited.
- Violations may result in technical countermeasures (IP blocking, account suspension) and legal action.
21. Advertising & Third-Party Services
- The Service may display advertisements from Google AdSense and similar networks. Ad content is the responsibility of the respective advertisers.
- The Service relies on third-party services including Stripe (payments), Anthropic Claude / OpenAI (AI generation), ElevenLabs (audio), AWS (infrastructure), and Google (analytics, advertising). Please review each provider's privacy policy.
- We are not responsible for the content, accuracy, or safety of any third-party content linked from our Service.
22. Service Availability
We do not guarantee uninterrupted availability of the Service. The Service may be temporarily suspended due to:
- System maintenance, updates, or inspections
- Force majeure events (natural disasters, power outages, network failures)
- Third-party service disruptions (AI APIs, cloud infrastructure)
- Other circumstances we deem necessary
23. Data Backup & Recovery Limits
- We maintain reasonable backups but do not guarantee data integrity or permanence.
- Data deleted by you (including via account closure) may not be recoverable from our backups.
- For important content, we recommend you maintain local copies or exports.
24. International Use, Sanctions & Export Control
- The Service may not be used by persons in U.S.-sanctioned countries/regions or by individuals/entities on U.S. prohibited-party lists (OFAC, BIS Entity List, etc.).
- You are responsible for compliance with the laws of your country of residence.
- EU/EEA users have mandatory rights under GDPR that are not limited by these Terms.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
Limitations do not apply to damages caused by our willful misconduct or gross negligence, or where prohibited by mandatory consumer protection law.
26. Indemnification
You agree to indemnify, defend, and hold harmless Novelia from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your User Content, or your use of the Service in violation of applicable law or third-party rights.
27. Service Changes & Termination
- We may modify the Service with prior notice.
- We may discontinue the Service with reasonable advance notice (30 days).
- Upon termination, we will provide reasonable accommodation for unused point balances (partial refund or alternative).
28. Assignment & Succession
- We may transfer our rights and obligations relating to the Service through merger, acquisition, asset sale, or other means. In such cases, your personal data, Content, and Points pass to the successor.
- You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
29. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via in-Service notice or email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance.
30. Notices
- We provide notices to you via email to your registered address, in-Service announcements, or postings on our website.
- You provide notices to us via email to support@novelia.site.
- You are responsible for keeping your registered information current. If notices fail to reach you due to outdated information, we will be deemed to have provided notice.
31. Dispute Resolution & Arbitration (US Users)
If you are a resident of the United States, the following arbitration clause applies:
- Any dispute arising from these Terms will be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court.
- Class action waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.
- Opt-out: You may opt out by emailing support@novelia.site within 30 days of first using the Service, with "Arbitration Opt-Out" in the subject line.
32. Governing Law & Jurisdiction
These Terms are governed by the laws of Japan. Disputes (excluding those subject to arbitration above) shall be exclusively submitted to the Tokyo District Court as the court of first instance. For users outside Japan, nothing in these Terms limits your rights under the mandatory laws of your country of residence. EU/EEA users have additional rights under consumer protection laws.
33. Entire Agreement & Severability
- Entire Agreement: These Terms, together with any documents expressly incorporated (Privacy Policy, Specified Commercial Transactions Act Disclosure, etc.), constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
- Severability: If any provision is held invalid, illegal, or unenforceable, the remaining provisions remain in full effect. Invalid provisions will be replaced by valid provisions that approximate the original intent.
- No Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
34. Language Priority
These Terms are provided in Japanese and English. In case of conflict, the Japanese version prevails for users in Japan, and the English version prevails for all others. Mandatory consumer protection laws in your country of residence may override.
